This is a second appeal from an action brought by Eugene and Vesna Shabinaw against Charles Brown, M.D. (Dr. Brown) alleging medical malpractice and lack of informed consent. After judgment was entered in favor of Dr. Brown upon a jury verdict of no liability, the district court granted a partial new trial on the issue of informed consent. Dr. Brown appealed the order granting a new trial. This Court vacated the order on the grounds that the district courts decision was based upon case law which was subsequently overruled. This Court remanded the case to the district court to reconsider its decision in light of the new case law. The district judge who initially ordered a new trial retired prior to ruling on remand. The newly assigned district judge again entered an order granting a new trial. Dr. Brown appeals the order.
